Before the court provides a favorable decision to nullify the marriage, spouses need to demonstrate that they have lived apart for at least 60 days. It is permitted to live in one home for these 60 days, although without sexual cohabitation.

Spouses have to convince the court that the marriage is broken beyond repair. This is done if both spouses agree that they have no chances of getting back together. However, it is important to know that a judge may require conciliation if they are unconvinced.
